# TERMS & CONDITIONS

These Terms & Conditions ("Terms", "Terms of Use" or "Agreement") govern your access to and use of the HOMESNAP mobile application and the PHS Construction Arena website (phsconstructionarena.com), together with related software, platform and services (collectively, the "Platform"), owned and operated by PHS BPRD PVT LTD, a company incorporated under the Companies Act, 2013, having its principal place of business at Barpeta Road, Assam, India ("Company", "We", "Us" or "Our").
Note on scope: These Terms apply uniformly whether You access the Platform through the Website (phsconstructionarena.com) or the Mobile Application (available on the Google Play Store and/or Apple App Store), and any reference to "Platform" below includes both, unless a clause expressly states otherwise.
The Platform is intended to provide customers with access to construction materials, building products, home-delivery services and construction/home-improvement related services.
By accessing, browsing, downloading, installing, registering on, placing an Order through, booking a Service through, or otherwise using the Platform, you ("User", "Customer", "You", "Your" or "Yourself") acknowledge that you have read, understood and agreed to these Terms, together with the Privacy Policy, Refund & Cancellation Policy, Delivery Policy and any Product- or Service-specific terms applicable to your transaction.
If you do not agree with these Terms, you must not use the Platform.
1. DEFINITIONS
For the purposes of these Terms:
1.1 "Platform"
Means, collectively, the PHS Construction Arena website (phsconstructionarena.com) and the HOMESNAP mobile application(s), together with related software, digital interfaces and services operated by the Company.
1.2 "App" / "Website"
"App" means the mobile application component of the Platform, distributed via app stores. "Website" means the web-based component at phsconstructionarena.com. Where a right or obligation is specific to one, it is stated expressly; otherwise it applies to both.
1.3 "Customer" / "User"
Means any person who accesses or uses the Platform (App and/or Website), purchases Products or books Services.
1.4 "Product"
Means construction materials, hardware, plumbing, sanitary, electrical, tools, finishing materials, fixtures, fittings, equipment or any other goods made available through the Platform.
1.5 "Seller"
Means the Company or an independent manufacturer, supplier, distributor, dealer, merchant or other third-party seller offering Products through the Platform.
1.6 "Service"
Means delivery, transportation, installation, repair, maintenance, labour, professional consultation, construction assistance, home improvement or any other service offered or facilitated through the Platform.
1.7 "Service Provider"
Means a person or entity providing Services through or in connection with the Platform, including architects, engineers, contractors, plumbers, electricians, carpenters, painters, masons, labourers, installers, technicians and other professionals.
1.8 "Order" / "Booking" / "Quotation" / "Order Confirmation"
As conventionally understood — a request to purchase Products, a request for Services, a price estimate, and the Company's/Seller's confirmation of acceptance, respectively.
1.9 "Third-Party Service Providers" (technology)
Means the technology vendors engaged by the Company to operate the Platform, including but not limited to Truecaller (mobile number verification/authentication), Firebase (Google) (app infrastructure, analytics, crash reporting, push notifications, cloud storage/hosting), and various AI/ML-based software tools (used for functions such as product recommendations, chatbot/customer support, content or image processing, fraud detection, and similar automated features), each governed further under Clause 51 (Data & Privacy) below.
2. NATURE AND SCOPE OF THE PLATFORM
The Platform is intended to function as a technology-enabled construction and home-improvement ecosystem, accessible interchangeably via the Website and the App.
Depending upon location and availability, the Platform may provide or facilitate access to:
- 1. cement; 2. TMT steel and structural steel; 3. bricks, blocks, sand and aggregates; 4. plumbing products; 5. sanitary products; 6. electrical products; 7. hardware and tools; 8. paints and finishing materials; 9. waterproofing and construction chemicals; 10. tiles and flooring products; 11. doors, windows and fittings; 12. construction equipment; 13. home-delivery and transportation; 14. loading/unloading assistance; 15–24. architects, engineers, interior designers, plumbers, electricians, carpenters, painters, masons, labour contractors, installers and technicians; 25. site visits and measurements; 26. construction estimates; 27. project coordination; and 28. other construction or home-related Products and Services introduced from time to time.
Availability may vary by location, inventory, supplier, Service Provider availability, regulatory restrictions and operational capacity.
3. PLATFORM BUSINESS MODEL
The Company may operate the Platform through one or more models: Inventory Model (Company sells directly), Marketplace Model (independent Sellers/Service Providers transact with Customers via the Platform), or a Hybrid Model combining both. The applicable Seller, supplier or Service Provider shall be identified where required by applicable law or where material to the transaction.
4. ELIGIBILITY
You must have the legal capacity to enter into a binding contract under applicable Indian law. If you are a minor, you may use the Platform only under the supervision and with the consent of your parent or legal guardian where permitted by law.
By using the Platform (App or Website), you represent that: information supplied by you is accurate; you have authority to provide such information; you will comply with applicable law; and you will use the Platform only for lawful purposes.
5. ACCOUNT REGISTRATION AND MOBILE NUMBER VERIFICATION
Certain Platform features require registration, on both the App and the Website.
5.1 Registration via Truecaller / OTP
The App and/or Website may offer sign-up/login using Truecaller's one-tap number verification, or a standard SMS-based OTP. Where you choose Truecaller verification, you authorise Truecaller to share your verified mobile number and any associated profile information (as permitted by your Truecaller app settings) with the Company for the purpose of account creation and authentication. You may always opt for manual OTP-based registration instead of Truecaller if you do not wish to use that service.
You agree to:
- 1. provide accurate information;
- 2. maintain updated account information;
- 3. protect your login credentials and OTPs;
- 4. not share your account with unauthorised persons;
- 5. immediately notify us of suspected unauthorised access; and
- 6. remain responsible for activity carried out through your account, subject to applicable law.
We may suspend or restrict an account where we reasonably believe that it has been compromised, fraudulently used or used in violation of these Terms.
6. AUTHENTICATION, OTP AND DEVICE PERMISSIONS
Where OTP, Truecaller, password, biometric authentication or another authentication mechanism is used, you are responsible for maintaining reasonable security over your device and authentication information. You must not knowingly disclose an OTP or authentication credential to an unauthorised person.
The App may request device permissions (e.g., storage, camera, location, notifications) to enable specific features (e.g., uploading a site photo for a Service request, delivery-location tagging, push notifications for Order updates). Permissions are used only for the stated purpose and you may withdraw them through your device settings, though this may limit certain features.
The Company may rely on an OTP, Truecaller verification, or other authorised electronic authentication mechanism as evidence of user confirmation, subject to applicable law.
7. ACCURACY OF USER INFORMATION
You agree to provide true, complete and accurate information, including: name; mobile number; email; delivery address; project address; measurements; Product quantities; site information; billing details; GST details, where applicable; and information necessary for Services.
You are responsible for losses, delays or additional costs caused by materially incorrect information supplied by you, subject to applicable law.
8. PRODUCT LISTINGS
We endeavour to maintain accurate information concerning Products across both the Website and the App. Product information may be provided by manufacturers, Sellers or suppliers and may change from time to time. Product photographs are illustrative unless expressly stated otherwise. Differences may occur in colour, packaging, appearance, dimensions, model, batch, manufacturer packaging or other non-material characteristics. Manufacturer specifications shall prevail where applicable.
9. PRODUCT SPECIFICATIONS, TECHNICAL INFORMATION AND AI-ASSISTED FEATURES
Technical specifications, construction guidance, material recommendations, calculators and other information available through the Platform are provided for general informational purposes unless expressly stated to constitute professional advice.
Where the Platform uses AI/ML-based tools (e.g., a chatbot, an automated product recommender, or an image-based search/estimation feature), such outputs are generated automatically and are indicative only. They are not a substitute for professional advice from a qualified architect, engineer, or other appropriate professional, and the Company does not guarantee the accuracy or suitability of AI-generated recommendations for any individual construction project.
10. CONSTRUCTION CALCULATORS AND ESTIMATES
Any material calculator, quantity estimator, cost estimator or construction-budget tool (including any AI-assisted estimator) available through the Platform is an indicative tool unless expressly described otherwise. Actual material requirements may vary due to structural/architectural design, site/soil conditions, wastage, construction methodology, local practices, measurements, design changes, regulatory requirements and other factors. Customers should obtain professional project-specific calculations where required.
11. DYNAMIC AND VOLATILE PRICING

11.1 Indicative Prices
Unless expressly stated as fixed, a price displayed during browsing, search, quotation, estimation or cart creation on the App or Website may be indicative and subject to confirmation. Adding an item to a cart does not necessarily constitute a binding purchase.
11.2 Price Verification
Where applicable, the Platform may verify the prevailing price immediately before final Order Confirmation. If the price has changed, the revised price shall be displayed or communicated to the Customer before final confirmation, wherever reasonably practicable. The Customer may then accept the revised price and confirm, or decline and cancel the affected Order before final confirmation.
11.3 Final Confirmed Price
The price displayed and accepted at final Order Confirmation shall ordinarily be the applicable Product price for that Order. Additional amounts may arise only where permitted by these Terms (Customer-requested changes, quantity/specification changes, additional delivery/site requirements, applicable tax changes, or correction of an obvious pricing/technical error).
11.4 Bulk Material Quotations
Bulk quotations may have a specific validity period; unless expressly stated otherwise, a quotation is not a price lock. Shorter validity periods may apply for highly volatile commodities such as steel, cement and certain bulk materials.
11.5 No Hidden Price Increase
The Company shall not use dynamic pricing to impose arbitrary or undisclosed charges after final confirmation where the price has already been conclusively accepted, subject to applicable law and the exceptions above.
12. PRICE ERRORS
Where a material technical, typographical or pricing error is identified before fulfilment, we may correct the error, contact the Customer, offer the Product at the correct price, or cancel the affected Order and process any eligible refund.
13–17. ORDER PLACEMENT, ACCEPTANCE, BULK ORDERS, MEASUREMENT, SUBSTITUTION

The Company may suspend listings, investigate and act where such conduct is identified.
19. PRODUCT RECALLS AND SAFETY NOTICES
Where a manufacturer/regulator/government authority issues a recall or safety notice, the Company may suspend sale, remove the listing, notify affected Customers (via App push notification, SMS, or email), coordinate return/replacement, and take other legally appropriate action.
20–25. DELIVERY, TIME, SITE ACCESS, HANDLING, ACCEPTANCE, DAMAGED PRODUCTS

Manufacturer warranties are governed by manufacturer terms unless expressly extended by the Company. Statutory consumer rights remain unaffected.
28–37. SERVICES, SERVICE PROVIDERS, ESTIMATES, LABOUR, SAFETY, PERMITS, CANCELLATION, ADDITIONAL WORK

38. OFF-PLATFORM TRANSACTIONS AND CIRCUMVENTION
Parties must not knowingly use information obtained through the Platform (App or Website) to fraudulently circumvent Platform procedures, payment requirements, warranties or safety processes.
39–42. USER CONDUCT, PROHIBITED CONTENT, MALWARE/SECURITY, REVIEWS

43. USER CONTENT LICENCE
Where you submit photographs (e.g., of a site or a Service issue), reviews, ratings, text or other content via the App or Website, you grant the Company a non-exclusive, royalty-free, worldwide licence to host, reproduce, process (including via AI/ML tools, e.g. for auto-categorising a service request from an uploaded photo), display and use such content for operating, improving and promoting the Platform, subject to applicable law and the Privacy Policy.
44. INTELLECTUAL PROPERTY
All rights in the Platform — software, source code, App binaries, interfaces, designs, graphics, logos, trademarks, photographs, databases, text, videos, audio, branding — belong to the Company or its licensors unless stated otherwise. You may not copy, reproduce, modify, distribute, commercially exploit, or reverse engineer such material except as permitted by law (including the reverse-engineering exceptions under the Copyright Act, 1957 for App software, where applicable).
45. THIRD-PARTY SERVICES
The Platform integrates with third-party providers, including but not limited to:
- Truecaller — mobile number verification/authentication;
- Firebase (Google LLC) — app hosting, cloud database/storage, push notifications, crash reporting and analytics;
- AI/ML-based software tools — for product recommendations, chatbot/customer support, automated content or image processing, and fraud/anomaly detection;
- payment gateways;
- logistics/delivery partners;
- mapping/location services;
- SMS/communication gateways; and
- other third-party services as may be integrated from time to time.
Such services operate under their own separate terms and privacy policies, and the Company encourages you to review them (e.g., Google's Privacy Policy for Firebase, Truecaller's Privacy Policy). See Clause 51 for how your data is shared with these providers.
46–50. PAYMENT, PAYMENT GATEWAYS, GST/TAXES, OFFERS, NO DARK PATTERNS

51.1 What we collect and why
The Company may collect and process information necessary to: create and verify accounts; process Orders and Bookings; deliver Products and arrange Services; process payments; prevent fraud and abuse; provide customer support (including AI-assisted chat support); send transactional and promotional communications; personalise recommendations; and comply with law.
51.2 Sharing with Third-Party Technology Providers
As part of operating the Platform, your data may be shared with, or processed by, the following categories of third-party service providers, strictly for the purposes stated:

We share only the minimum data reasonably necessary for each provider to perform its specific function, and each provider is contractually/technically bound (via their own terms, DPAs, or platform policies) to use that data only for the stated purpose, not for their own independent marketing without your separate consent to them.
51.3 Consent
By registering on, or using, the App or Website, you consent to this processing and sharing, in accordance with the Privacy Policy. Where required under the DPDP Act, specific, informed, and withdrawable consent will be sought via clear notices (e.g., before Truecaller verification, before uploading a photo for an AI-assisted feature). You may withdraw consent at any time through the App/Website settings or by contacting the Grievance Officer, subject to the effect this may have on your ability to use certain features.
51.4 Data Retention, Security and Breach Notification
Data is retained only as long as necessary for the stated purpose or as required by law, and is protected using reasonable technical and organisational security safeguards. In the event of a personal data breach, the Company shall notify the Data Protection Board of India and affected Users as required under the DPDP Act.
51.5 Your Rights
Subject to the DPDP Act and its Rules, you may have the right to access, correct, update, or request erasure of your personal data, to withdraw consent, and to nominate another individual to exercise your rights in the event of death or incapacity. Requests may be made through the Grievance Officer (Clause 68) or a dedicated in-App/Website privacy contact point.
51.6 Children's Data
The Platform is not intended for use by minors without parental/guardian consent as described in Clause 4. The Company does not knowingly collect personal data of children in a manner inconsistent with the DPDP Act's requirements for processing children's data (including verifiable parental consent and a prohibition on tracking/behavioural advertising directed at children).
52. ELECTRONIC COMMUNICATIONS AND RECORDS
By using the App or Website, you consent to receive transactional communications via SMS, email, push notifications (App), telephone, WhatsApp/messaging services, and in-App/on-Website communications. Electronic records (Order confirmations, quotations, invoices, OTP confirmations, delivery records, photographs, support chats — including AI chatbot transcripts, payment records) may be maintained and relied upon as evidence to the extent permitted by law (Information Technology Act, 2000).
53–61. PLATFORM AVAILABILITY, DISCLAIMERS, LIABILITY, PRODUCT SAFETY, CONSTRUCTION OUTCOME, CUSTOMER RESPONSIBILITY, EMERGENCY STOPPAGE, FORCE MAJEURE

69. CONSUMER RIGHTS
Nothing in these Terms excludes, restricts or waives rights available to a consumer under the Consumer Protection Act, 2019, Consumer Protection (E-Commerce) Rules, 2020 and other applicable legislation.
70. LEGAL AND REGULATORY COMPLIANCE
The Company shall endeavour to comply with applicable laws, including, where applicable: Companies Act, 2013 (if incorporated) / applicable business-registration laws; Consumer Protection Act, 2019; Consumer Protection (E-Commerce) Rules, 2020; Legal Metrology laws; GST laws; Digital Personal Data Protection Act, 2023 and Rules thereunder; Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to the extent applicable; Google Play Store Developer Program Policies (including Data Safety disclosures) and Apple App Store Guidelines, where the App is distributed on those platforms; and other applicable Central and State laws.
71–77. CHANGES TO PLATFORM/TERMS, SEVERABILITY, WAIVER, ASSIGNMENT, NO AGENCY, ENTIRE AGREEMENT

78. GOVERNING LAW
These Terms shall be governed by the laws of India. Subject to mandatory statutory jurisdiction available to consumers, courts/competent authorities at Guwahati, Assam shall have jurisdiction over disputes arising from these Terms.
79. DISPUTE RESOLUTION
Customers should first contact Customer Support or the Grievance Officer. Where legally permissible, parties may attempt mediation before other proceedings. Nothing prevents a consumer from approaching an appropriate Consumer Commission or other competent authority.

81. CUSTOMER ACKNOWLEDGEMENT
By selecting "I Agree", "Place Order", "Confirm Order", "Book Service", "Pay Now" or a similar confirmation mechanism on either the App or Website, you acknowledge that you have read and understood these Terms, reviewed the applicable pricing and charges, understand that prices may fluctuate before final confirmation, understand that certain Services may be performed by independent Service Providers, and agree to the applicable Privacy Policy (including sharing of data with Truecaller, Firebase, and AI-based tools as described in Clause 51), Refund & Cancellation Policy, and other Platform policies.
82. IMPORTANT PRICE NOTICE
PRICE NOTICE: Construction-material prices may change frequently due to prevailing market conditions, supplier revisions, commodity prices, freight, taxes and availability. The price displayed before final confirmation may therefore change. The final payable price will be displayed for your review before the Order is finally confirmed.
